Certain products or services may be available exclusively online through our website. Products may be available in limited quantities and are subject to our Shipping & Returns Policy and any rights available to you under applicable law.
We make reasonable efforts to display product images, packaging, colours, and descriptions accurately. However, the appearance of products may vary slightly due to photography, packaging updates, manufacturing variations, or the display settings of your device.
Our products may be manufactured by third-party manufacturers and may be stored, processed, fulfilled, shipped, or delivered by third-party warehousing, fulfillment, logistics, and delivery providers acting on our behalf, including providers located in Ontario. Athonix Performance Nutrition Inc. remains the seller of products purchased directly through our website.
We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction where permitted by law. Product descriptions, formulations, packaging, availability, and pricing may change from time to time. Changes will not affect any rights you may have in relation to an order already placed, except as permitted by applicable law.
5. Natural Health Product and Health Disclaimer
Our products are natural health products. They are not intended to diagnose, treat, cure, or prevent any disease except to the extent expressly authorized by Health Canada and stated on the applicable product label or product licence.
Always read and follow the product label, including the recommended use or purpose, recommended dose, directions for use, cautions, warnings, contraindications, and other information provided with the product.
Information presented on our website, social media, marketing materials, or through other communications is provided for general informational purposes and is not a substitute for medical advice, diagnosis, or treatment.

You are responsible for using products in accordance with their labels and directions. Nothing in these Terms excludes or limits any rights, remedies, warranties, or protections that cannot lawfully be excluded under applicable law.
6. Orders, Billing, Payment, and Account Information
We reserve the right to refuse, limit, or cancel an order where permitted by applicable law, including where we reasonably suspect fraud, unauthorized resale, abuse of promotions, pricing or inventory errors, or other misuse of our Services.
We may limit quantities purchased per person, per household, per customer account, per payment method, or per order.
If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method, subject to applicable law.
You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for orders placed through our store and to update your information as necessary so that we can complete transactions and contact you regarding your order.
7. Shopify and Third-Party Service Providers
Our online store is hosted and powered by Shopify. Shopify provides the ecommerce technology that enables us to offer our Services to you, but products purchased directly through our website are sold by Athonix Performance Nutrition Inc.
We also use third-party service providers to operate our business and provide the Services, including payment processors, manufacturers, warehouses, fulfillment providers, shipping and delivery carriers, technology providers, analytics providers, marketing platforms, and customer support services.
Orders may be manufactured, stored, processed, fulfilled, shipped, or delivered by third-party providers acting on our behalf. Certain third-party services may also be governed by their own terms, policies, or privacy notices.
To the extent permitted by applicable law, we are not responsible for the independent acts, omissions, websites, products, or services of third parties that are outside our reasonable control. Nothing in this section limits any responsibility that Athonix has to you as the seller of products purchased directly from us or any rights you have under applicable law.

You may stop using the Services at any time.
We may suspend or terminate your access to the Services where reasonably necessary, including if you materially breach these Terms, engage in fraudulent or unlawful activity, or misuse the Services.
Termination does not affect rights or obligations relating to transactions completed before termination or provisions that by their nature are intended to survive termination.
16. Entire Agreement
These Terms, together with our Privacy Policy, Shipping & Returns Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Athonix Performance Nutrition Inc. regarding your use of the Services and purchases made directly from us.
Nothing in these Terms limits any rights or protections that cannot be waived under applicable law.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, subject to any mandatory consumer protection laws or other legal rights that apply to you and cannot be waived or restricted by agreement.
